Terms of Use
These terms cover the use of this website and everything published on it. They sit alongside our Terms of Service, which govern orders and sales, and our Privacy Policy. Using this site means accepting the terms below.
The site is operated by Scuba Evolution, registration 2014/213535/07, VAT 4770295733, a PADI 5 Star Dive Centre trading in South Africa.
Who owns what is on this site
The written content on this site is our own work. Product descriptions, course pages, dive guides, blog articles, category and collection structure, page layout and site code are original literary and artistic works. Under the Copyright Act 98 of 1978 they are protected from the moment they are created. No registration is needed and no notice is required for that protection to apply.
Some material on this site belongs to other people. Manufacturer photography, brand logos, model names and technical specifications remain the property of the brands concerned, including Scubapro, Apeks, Aqualung, Fourth Element, Garmin, Suunto, Shearwater, XDEEP, Big Blue, OrcaTorch, Mares and others. That material appears here under our supply arrangements with those brands. PADI marks belong to PADI. Nothing on this page claims ownership of it, and nothing on this page gives anyone else permission to use it.
What you may do
- Browse the site and read anything published on it.
- Print pages for your own reference, including product pages, course pages and dive guides.
- Save or print an order confirmation, invoice or policy page for your records.
- Share a link to any page on this site, anywhere.
- Quote a short extract in a review, article or forum post, provided the quote is attributed to Scuba Evolution and links back to the page it came from.
Printing is deliberately left open. A diver who wants a course outline or a kit specification on paper before a dive should be able to take one.
What you may not do
- Reproduce, republish or adapt our product descriptions, course content, guides or photography for any commercial purpose, in any medium, whether on a website, a marketplace listing, a catalogue, a price list or printed material.
- Access the site by automated means. This includes scraping, crawling, harvesting, spidering, bulk downloading and any scripted or headless collection of pages, images or data, whether from HTML pages, JSON endpoints, product or collection feeds, search endpoints or sitemaps. Search engines and AI assistants that follow our robots.txt are the exception, as set out under Automated access below.
- Use any content from this site to fine-tune or evaluate a machine learning model or dataset.
- Copy the structure, navigation, category taxonomy, layout or visual design of the site so as to produce a site that resembles this one.
- Mirror, frame, embed or re-host any part of the site.
- Resell, licence or redistribute our catalogue data, including titles, descriptions, part numbers, specifications, stock positions or prices.
- Remove, obscure or alter any ownership notice, attribution or identifying marker.
- Interfere with the running of the site, or attempt to reach areas of it that are not published for public use.
Automated access
Our robots.txt file forms part of these terms. Any automated access that ignores it is unauthorised, and so is any automated access that continues after we have asked for it to stop. We may rate limit, block or refuse access to any client, address or agent, and we are not obliged to give a reason.
Search engines and answer engines that respect robots.txt are welcome. Indexing this site so that divers can find it is a use we support.
AI assistants and AI search tools that respect robots.txt may quote short extracts from our pages, or summarise them, in their answers, provided the answer links back to the page it came from.
Identifying markers
Pages on this site carry identifying markers that allow a copy to be traced back to its source. Those markers are part of the work. Stripping them out does not create a licence to use the content, and does not make a copy lawful.
If you find our content on another site
Tell us. Send the address of the page and a screenshot to shop@scubaevolution.co.za. Reports from customers have a better record of finding copies than any automated check.
How we deal with infringement
Where content from this site is reproduced without permission, we pursue the following routes:
- A written demand to the operator of the site, and to the business behind it.
- A take-down notification under section 77 of the Electronic Communications and Transactions Act 25 of 2002, sent to the host or service provider where that provider belongs to a recognised industry representative body.
- An intellectual property complaint to the platform hosting the copy, including Shopify, where the copy sits on a hosted store.
- A complaint to the marketplace or advertising platform carrying the listing.
- Civil proceedings under the Copyright Act 98 of 1978, which allow for an interdict, damages and delivery up of infringing material.
Accuracy
Specifications, prices and stock positions on this site are kept current as far as is practical, and they change. Technical content is general information about diving equipment and training. It is not a substitute for a fitness to dive assessment, an in-water skills check, or an instructor's judgement on the day.
Changes to these terms
These terms may be updated. The version published on this page at the time of your visit is the version that applies. Material changes will carry a revised date below.
Governing law and contact
South African law governs these terms and any dispute arising from them.
